Criminal Justice Class 23

[OOC: He's back! And after a couple pretty serious classes, it's time to have some fun! Weeeeeee! And this is up a little extra early today because I am, too. Back to sleep for another hour, though! Class Info Link.]

*The Tick is at the podium, looking excited and maybe just a bit nervous. This was his first class in two weeks, after all. On his desk is his gradebook. It has, for some reason, some turkey feathers on it. There may be a story there. Lockheed is perched atop his normal bookcase.*

Hello, students! It's been a while! I understand that class has been good in my absence. I have to take a moment to thank Lockheed and Rory for filling in while I was taking care of a situation back home. Thank you both! You're extremely keen for helping me out like that!

A few points of note before our discussion today: First, extra credit should be given to Rory since I don't even know what it is. Second, remember, the end of term is less than a month away. You should probably start looking over your notes soon so you aren't caught unprepared at the last minute. Third, you'll get your quizzes back on Tuesday. Sorry for the delay, but things have been hectic.

And finally, we will be having a special class a week from Tuesday. On December 13th, we will be having a panel discussion. The panel will consist of four of my fellow superheroes from The City. Each one has a unique perspective on heroism and Justice, so it should be a fun time. For the people who aren't playing all four of them, plus Tick and Lockheed, at least. For people like that, we'll have a pool going for how long it takes before the mun's head explodes. Come prepared with plenty of questions for them!

Finally, our discussion. Put aside any ethical objections you may have to hunting. We're going to be looking at it from a strictly legal perspective.

I have reports of at least one incident where a hunter was misled by anthropomorphic animals - who have, it should be noted, pretty keen minds and are from the same dimension as our old friend Mr. Road Runner - into thinking that it was rabbit season when it was, in fact, duck season. Now, this man, Mr. Elmer Fudd, is a professional hunter, fully licensed for hunting and handling firearms. If he is tricked by the animals into shooting an out-of-season animal - such as a rabbit, a goat, a mongoose, a dirty skunk, or a baseball - what should happen to Mr. Fudd? Should he be punished? Lose his hunting license? Or should he get off because he was tricked? And should anything be done to the animals who performed this trickery?

Cameron might comment about how the hunter should be better informed if he's going to do something that could potentially dangerous. As it is, he kinda gets distracted at the thought of hunting.

Lifting his muzzle, he sniffs up the air. Is that a mouse scent? He jumps from the seat he has taken and starts sniffing around the floor as if he's following some kind of trail.

Vala is too busy snerking at CamPuppy to answer right away, but The Tick isn't someone who can lose your attention for long.

"Well, if he was really tricked, then I don't think he should be punished, just maybe warned to not trust, you know, sneaky talking animals.

"Yeah," she says, warming to her subject. "He should be warned to check with official sources about the actual season. And the animals should be punished somehow... and made to keep from tricking any other idiots they can find."

Vala looks pleased with her answer.

"First, if a hunter is claiming that a talking rabbit convinced him that it was duck season and not rabbit season, I should think that the first order of business would be to put the hunter into a psychiatric facility. I mean come on! A talking rabbit? If it was a rhyming toaster I might be able to believe him."

Marty then idly wonders why the Tick never takes any class material from his favorite TV series... Crime and Justice, Crime and Justice: SUV, and Crime and Justice: Illegal Intentions.

"All the people- animals?- involved should be punished, actually," Aeryn says. "If this Fudd person goes through with the crime, then he deserves some sort of punishment for his stupidity, though the... rabbit? or... whatever tricked him, then he's partially at fault for whatever happens."

Sometimes Aeryn can't believe she has to say words like this.

Janet has dragged herself in and just sort of stares at a bouncing, ball-chasing Cameron for a while. Until she manages to wake up, at least, and then she listens to the discussion objective.

"Wait, doesn't Elmer Fudd lose his temper halfway through the cartoon hunting season? And the duck too? The bunny's the only one that keeps his cool. So maybe Elmer Fudd and the duck need to take anger management courses."

Janet sometimes really, really can't believe the stuff she says in this class.

"I mean, did the other animals--and the baseball--die? If not, then then anger management courses for Fudd and the duck, and probably lots of community service for all three of them, because they were all in the wrong, each in their own way. And I don't know if Fudd should lose just his hunting license. Why is someone with anger management problems allowed to carry around a firearm?"

Something else occurs to Janet. "And the bunny's a manipulative little guy who'd do anything for his own gain. He could just hide during rabbit season, but no, he has to go around looking for ducks to trick Fudd into killing. Is the bunny a sociopath?"

As she finishes up, Janet wonders where Lockheed is. She brought a cookie or two just for him.

"Well, it all comes down to personal responsibility, doesn't it?" Anakin asked. "Because tricked or not, if the hunter did shoot something out of season, there needs to be a punishment." He frowned. "Perhaps there needs to be a greater devotion to the screening process for granting hunting licenses and weapons safety if a being who is going to be listening to talking animals is allowed near firearms at all."

He took a moment to hide a smile at CamWolf behind his hand. "I think he should definitely have his license withdrawn. The animals, if they are subject to jurisdiction in this world, should also be held accountable as accessories to the crime."

As class finishes, there's a lot of shuffling about and the rubber ball gets away from Cam. He's been good udnerneath the desk, but as the ball rolls right in front of Anakin's feet, he lunges after it, barreling right into the padawan.

[Most serious hunters have their seasons memorized, if they shoot an animal that's not in season they should be held accountable. If he shoots an animal out of season then he needs to have his hunting license taken away and if he was convinced by someone else that it was a different season (And be default a different month) then his gun permit should also be revoked.

Hunting seasons change from state to state and yet are generally the same, cotton-tail rabbit season tends to run from mid September until late February while Duck season is generally shorter, running on and off from late September until early October in some places and early October until early December in others.

Because of the potential for crossover in seasons all hunters who hunt for both rabbit and water-foul must be mindful of the dates and be held extra-accountable for any mistakes they make. They cannot be let go without punishment because they were "tircked" into it. If that were to happen how would we be able to prevent poachers who would undoubtably claim that they "didn't know" a particular animal wasn't allowed to be shot in any season?

It's sad how much fun I have with this.]
